Terms of Service

Welcome to Presencia Studios. These Terms of Service ("Terms") govern your use of our website-design subscription service. By subscribing, you agree to these Terms.

1. Who We Are

Presencia Studios is a digital service operated as a sole proprietorship from the Republic of Turkey. You can reach us at hello@presenciastudios.com.

2. What You Get

When you subscribe, you receive:

• A professionally designed, custom-built website made specifically for your business
• A custom domain of your choice, registered and operated by us on your business's behalf for the duration of your subscription
• Managed hosting on our infrastructure
• SSL security
• One content update cycle per 30-day period, submitted by email. Each cycle can include any combination of changes (menu, hours, photos, text, layout, colors, contact details, gallery) — bundle as much as you want into one request and we apply them in a single pass. Unused cycles do not roll over (use-it-or-lose-it). Extra cycles within the same 30-day period are available at $39 USD each.
• A monthly performance report covering website traffic, visitor behaviour, and basic SEO metrics, delivered by email
• Ongoing maintenance, security updates, and uptime monitoring

3. Billing and Subscriptions

All sales are processed by Paddle.com Market Ltd ("Paddle"), which acts as the reseller and Merchant of Record for every subscription. Paddle handles payment collection, invoicing, sales tax and VAT compliance in each customer's jurisdiction, and chargebacks.

• Subscriptions are offered at $79.99 USD per month or $849.99 USD per year.
• Monthly subscriptions renew automatically every month. Annual subscriptions renew automatically every twelve months.
• Your chosen payment method is charged on each renewal date until you cancel.

4. Your Responsibilities

By subscribing, you confirm that:

• The information you provide about your business is accurate and lawful.
• Any content you ask us to include on your website — images, text, menus, contact information — does not infringe third-party rights and complies with applicable laws.
• You have the authority to enter into this agreement on behalf of your business.

5. Our Responsibilities

We commit to:

• Building your website using the details you provide and our professional creative judgment.
• Delivering an initial preview within 72 hours of receiving your information.
• Two pre-live revision sessions included at signup, to dial in your site during onboarding before it goes live. Each session can include any combination of design, copy, photo, layout, or content changes — bundled and applied as a single pass. These two pre-live sessions are consumed when the site goes live, whether or not you used both.
• One free revision session every 30-day period after the site goes live, while your subscription remains active. This is the same monthly content-update cycle described in Section 2. Unused sessions do not roll over (use-it-or-lose-it).
• Additional revision sessions at $39 USD each, beyond the free tier (two pre-live plus one per 30-day post-live cycle), billed as one-off charges through Paddle.
• Maintaining your site on our infrastructure with reasonable uptime targets.
• Processing your monthly revision within five business days of receiving it.
• Sending your monthly performance report within the first week of each month.
• Keeping the domain used for your site registered (under Presencia Studios' account), paid, and operational throughout your active subscription. See Section 8 for the ownership model.

We do not guarantee specific search-engine rankings, traffic volumes, or business outcomes.

6. Cancellation

You may cancel at any time. To cancel:

• Use the self-service portal link provided in your Paddle invoice receipts, or
• Email us at hello@presenciastudios.com and we will initiate cancellation with Paddle.

After cancellation:

• Billing stops at the end of your current billing period.
• Your website remains live until the end of that period.
• Afterwards, we take the site offline. The custom domain registered during your subscription is retained by Presencia Studios (see Section 8).

7. Refunds

Refunds are handled under our separate Refund Policy, which is incorporated into these Terms.

8. Intellectual Property — A Rental Model

Your Presencia Studios subscription is a rental arrangement: you pay to use a professionally built website, and you may continue using it for as long as your subscription remains active. Ownership works as follows:

• Your content is yours. Anything you provide to us — text, logos, photos, business details — remains your property. You may take your own content with you at cancellation.
• Everything else belongs to Presencia Studios. This includes, without limitation: the website design, the underlying code (HTML, CSS, and any scripts), the hosting configuration, and the domain name registered during your subscription. We own these assets outright. You receive a license to use them only for as long as your subscription is active and paid.
• At cancellation, the website is taken offline, the licence ends, and all Presencia Studios–owned assets (including the domain, website files, and design) are retained by Presencia Studios. We do not hand over the site files or transfer the domain at cancellation.
• This is not a "work-for-hire" arrangement. You are not commissioning a website you will own; you are subscribing to an ongoing service that includes your use of a professionally built site.

9. Acceptable Use

We will not build or host websites that:

• Promote illegal activities, hate, violence, or harassment
• Operate in regulated industries we are not qualified to serve (gambling, pharmaceuticals, firearms, adult content, cryptocurrency investment, high-risk financial services)
• Infringe third-party intellectual property
• Are designed to deceive or defraud visitors

We reserve the right to decline or terminate service for any business falling into these categories.

10. Termination by Us

We may suspend or terminate your subscription, with a pro-rated refund for the unused portion of your current billing period, if you violate these Terms, if your use of the service creates legal risk for us, or if you engage in abusive or harassing behavior toward us or our staff.

11. Warranties and Disclaimers

The service is provided "as is" and "as available." We make no warranties that the service will meet your specific requirements, be uninterrupted, or be error-free. We do not warrant any specific business results.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your subscription is limited to the amount you paid us in the twelve months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages — including loss of business, profits, data, or goodwill.

13. Changes to These Terms

We may update these Terms. We will notify subscribers by email at least 14 days before material changes take effect. Continued use of the service after that period constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes will be resolved in the courts of Istanbul, Turkey, except where the consumer-protection law of your country requires otherwise.

15. Preview Sites and Brand Assets During the Proposal

When Presencia Studios reaches out to a business that does not yet have a website, we may build a preview of what a website for that business could look like, as part of our proposal. This preview is:

• Private. Hosted on a non-indexed, obfuscated Netlify subdomain. Not discoverable by search engines. Shared only with the business it was built for.
• Built from publicly available sources. We use the business's own publicly accessible brand assets — business name, address, public contact details, and photographs that the business has uploaded itself to its own Instagram account or its own Google Maps business profile. We do not use photographs uploaded by reviewers or customers.
• Proposal-only. We do not publish it, do not index it for search engines, and do not use it in our own marketing or case studies.
• Removable on decline. If the business declines our proposal, we take the preview offline and delete it within 7 calendar days.
• Takedown on request. If a business at any point asks us to take down their preview, we do so within 48 hours, regardless of where they are in the proposal process.
• Not a contract. The existence of a preview does not obligate either party. We may withdraw, modify, or delete it at any time.

If you are a business that has received a preview from us and you want it removed immediately, reply to our email or contact us at hello@presenciastudios.com.

Subscriber content licence. Once you subscribe, you grant Presencia Studios a non-exclusive, royalty-free, worldwide licence to use your business's brand assets — including name, logo, photographs, and any other content you submit or make publicly available — on the hosted website we build and maintain for you. This licence applies for the duration of your subscription and up to 30 days after cancellation, to allow for orderly shutdown. Ownership of your assets remains yours throughout. You represent and warrant that you have the right to grant this licence and that your assets do not infringe on the rights of third parties.
